No Stolen Trademarks Honored in America Act of 2023

Sponsored By: Representative Issa, Darrell [R-CA-48]

Became Law

Summary

Bars U.S. recognition of trademarks tied to confiscated assets unless the original owner or a bona fide successor expressly agrees. It widens who must follow the ban and adds a test about what a claimant knew when they acquired rights.

Courts and agencies reject stolen trademarks

The law blocks U.S. courts and executive-branch agencies from recognizing rights in marks tied to confiscated businesses or assets. Recognition is allowed only if the original owner or a bona fide successor gives express consent. The rule applies when the claimant knew or had reason to know at purchase that the mark was the same as, or very close to, a confiscated mark. The law removes limits that once applied only to certain designated nationals, so it now covers anyone. This protects original owners and limits buyers who try to claim these marks.
