To require the Secretary of the Army to expedite the completion of agreements with non-Federal interests for beneficial use of dredged material from federally authorized harbors in the State of Ohio, and for other purposes.

Sponsored By: Representative Kaptur, Marcy [D-OH-9]

Introduced

Summary

This section creates an expedited process for the Army to approve partnerships that demonstrate beneficial uses of dredged material in Ohio harbors. It allows non-Federal partners to be reimbursed through subsequent user fees and lets some projects proceed before a final dredged material management plan when plan completion is infeasible.

  • Non-Federal partners: Requests under WRDA 1996 section 217(c) get expedited review. Agreements may let the Army reimburse partners through later user fees under WRDA section 217(d)(2) and treat the partner as a private entity.
  • Harbor operators and communities: The Secretary may enter agreements before a dredged material management plan is finished if the plan is infeasible due to complexity, controversy, or limited dredging capacity. That helps address urgent maintenance dredging needs.
  • Army procedures: Before finalizing an agreement, the Secretary may apply the practices in 33 C.F.R. part 337 to the proposed facility.

Faster Army approval for Ohio dredging partnerships

If enacted, this bill would require the Secretary of the Army to speed up review of requests from non‑Federal partners to form partnership agreements to test beneficial uses of dredged material from federally authorized harbors in Ohio. If a dredged material management plan cannot be finished on time because of complexity, controversy, or limited harbor capacity, the Secretary would be allowed to enter the agreement before the plan is complete. Agreements reached after the expedited review could let the Army reimburse the non‑Federal partner later through user fees, treating the partner like a private entity under current law. The Secretary would also be able to apply the practices in 33 C.F.R. part 337 to the proposed facility. These changes would take effect upon enactment.
