Show full summary
  • Manufacturers, sellers, and trade associations can remove state-court civil actions they label as "qualified civil liability actions" to the federal district and division where the case sits and ask for dismissal.
  • Plaintiffs who file state-law suits may have their cases shifted to federal court and face dismissal if the district court finds the suit qualifies under PLCAA.
  • District courts are given explicit authority to decide whether a removed action is a qualified civil liability action and to dismiss it; those cases can be taken out of state court.

Gun industry could move cases to federal court

If enacted, gun makers, sellers, and trade groups could move some state lawsuits to federal court. They would need to claim the case is a “qualified civil liability action” under PLCAA. The case would go to the U.S. district court that covers where it was filed. That court could decide if it qualifies and dismiss the case if it does. This change would take effect upon enactment.
