HEART Act

Sponsored By: Representative Latimer, George [D-NY-16]

Introduced

Summary

Creates a State Department–run standard and certification process for naming 'safe third countries' and narrows when courts can review removals to them. It would also create a limited right for people facing removal to seek judicial review on narrow grounds and require release from detention while that review is pending.

Show full summary
  • People seeking asylum could challenge a safe third country removal on four specific grounds: the agreement does not apply to them; their life or liberty would be threatened for protected reasons; they would lack access to a full and fair asylum or equivalent protection procedure; or a technical implementation issue would unduly delay or interfere with removal. Challenges would proceed on prima facie evidence.
  • People pursuing that review would be released from detention for the duration of the court process.
  • The Secretary of State would have to issue a rule within 180 days setting minimum standards for safe third countries, including due process, a record of the rule of law, low risk of imminent conflict, compliance with refugee and human rights conventions, and sufficient economic resources to host refugees. The Secretary would also have to certify to Congress that a country meets those standards before designating it as a safe third country.
