Bill Overview
Analyzed Economic Effects
2 provisions identified: 1 benefits, 1 costs, 0 mixed.
New checks and shutdowns for port cranes
If enacted, DHS would have CISA inspect newly built foreign cranes before they start work at ports the Secretary marks high risk, when those cranes connect to the internet. Within 180 days after enactment, DHS would assess threats from foreign cranes already in use. DHS could take any risky crane offline until it is certified safe. DHS would brief House and Senate homeland security committees within 1 year on these risks.
Ban on foreign cranes and software
If enacted, operating a foreign crane at a U.S. port would be barred if its purchase contract is signed on or after enactment. Starting 5 years after enactment, foreign cranes at U.S. ports could not run foreign software; operators would need to remove or replace it. A covered foreign country would be one named as a foreign adversary by the intelligence community or by DHS with the intelligence chief. For these bans, a foreign crane would include cranes with software or other tech tied to companies based in those countries, and foreign software would mean software made by a company wholly owned by such a country.
