- Families and children: Sponsors would need fingerprint checks, National Sex Offender Registry checks, FBI criminal history checks, and state child abuse checks before placement. HHS may not place a child with a sponsor unlawfully present in the U.S. unless that person is a biological parent, legal guardian, or relative, and each child would receive a pre-release home visit and at least five unannounced in-person home visits in the first year and quarterly visits in the second year.
- Sponsors and household adults: Every person age 18 or older living in the sponsor's home must complete the same vetting before placement. The bill also requires retroactive fingerprint and vetting checks for sponsors who received children since January 20, 2021.
- Federal agencies and transparency: HHS and DHS would send joint monthly reports to Congress every 30 days with counts of encounters, custody, completed and pending background checks, pre- and post-release visits, placements by sponsor type, and lists of missing children.

Tighter checks for sponsors of unaccompanied children
If enacted, HHS would require a home visit before any unaccompanied child is released to a sponsor. The sponsor and every adult age 18+ in the home would need background checks: FBI fingerprints, public records, sex offender registry, state child abuse, and state and local criminal records. HHS could not release a child to someone unlawfully in the U.S., unless that person is the child's parent, legal guardian, or a relative. After release, HHS would make at least five unannounced in person home visits in the first year, then one visit each quarter in the second year. HHS would also run these checks on sponsors who took in children on or after January 20, 2021. These rules would take effect upon enactment.
