Sponsored By: Representative Harris, Mark [R-NC-8]

Introduced

Summary

Tightening asylum eligibility based on criminal convictions.

Show full summary

This bill makes noncitizens who have been finally convicted of a crime ineligible for asylum, and it lets the Secretary of Homeland Security carve out certain political offenses committed outside the United States by regulation.

  • Asylum seekers with a final criminal conviction are barred from asylum. This covers crimes defined as a felony or misdemeanor by the convicting jurisdiction or crimes punishable by more than one year in prison.
  • People who committed political offenses outside the United States may still qualify if the Secretary designates those offenses as exceptions through regulations.
  • Immigration officials and courts get clearer definitions of "felony" and "misdemeanor" tied to the convicting jurisdiction and the one-year punishment threshold.

Tighter asylum rules for convicted noncitizens

This bill would bar asylum for noncitizens with a final criminal conviction. It would cover both felonies and misdemeanors. A felony would mean a crime punishable by more than one year, or one labeled a felony by the federal, state, tribal, or local court. A misdemeanor would mean a crime punishable by not more than one year, or one labeled a misdemeanor. DHS could name some political offenses committed outside the United States that do not count, so those people could still seek asylum.
