Preserving Presidential Management Authority Act
Sponsored By: Representative Cloud, Michael [R-TX-27]
In Committee
Summary
presidential authority over collective bargaining agreements (CBA) for federal employees. This bill would let the President, acting through agency heads, terminate provisions of any CBA that are in force on the date the President swears or affirms the oath of office and treat CBA terms that conflict with presidential rules or orders as unenforceable.
Show full summary
- Federal employees and unions: Could see specific contract clauses ended at the start of a new presidency, which may remove protections negotiated under prior agreements.
- Agency heads: Would gain the power to terminate CBA provisions and to determine when contract language conflicts with presidential actions. They must send a written notice to the exclusive representative describing any termination or conflicting provisions.
- Incoming Presidents and transitions: Only a non-incumbent President could use this authority, so the power is tied to presidential transitions rather than use by an incumbent.

President could end parts of federal union contracts
If enacted, the President could, through agency heads, end parts of federal union contracts that are in force on the day the President takes the oath. Terms that conflict with a presidential rule, executive order, or memo would not be enforceable if the President or agency head decides so. The sitting President could not use the termination power. Agencies would have to give same-day written notice to the union. This would apply to federal civilian CBAs under title 5 and would take effect upon enactment.
