Bill Overview
Analyzed Economic Effects
2 provisions identified: 0 benefits, 1 costs, 1 mixed.
Ban on foreign-state lawsuit funding
If enacted, the bill would make it illegal for a foreign state or a sovereign wealth fund to provide money to start or run a civil lawsuit when it is not a named party. Parties and lawyers would be barred from accepting that money or from entering contingent-payment deals paid from those state-controlled funds. The bill would define who counts as a foreign person, foreign state, and sovereign wealth fund. The rules would apply to cases pending on or started after enactment.
New foreign litigation funding disclosures
If enacted, parties or their lawyers in federal civil cases would have to disclose in writing any foreign person, foreign state, or sovereign wealth fund that provided or agreed to provide money or that has a right to proceeds. They would need to give names, addresses, documents, and a signed certification under penalty of perjury about the source and amount. Disclosures would be due by the later of 30 days after the money or agreement or the date the case is filed, and must be corrected within 30 days after learning an error. Courts could void violating funding deals, dismiss affected cases with prejudice, reopen final judgments for fraud, and impose sanctions for false or missing disclosures.
