Infrastructure Project Acceleration Act

Sponsored By: Representative Langworthy, Nicholas A. [R-NY-23]

Introduced

Summary

Speeds federal approvals for very large U.S. manufacturing projects while cutting certain environmental and judicial hurdles. This bill would create an expedited review track for "priority manufacturing projects" defined as new or expanded U.S. facilities that cost at least $1 billion and need federal approvals. The bill says timely completion of these projects would strengthen U.S. manufacturing, support defense, healthcare, and communications, and reduce reliance on foreign suppliers.

  • Manufacturers: Project sponsors would get faster federal decisions for projects meeting the $1 billion threshold and face fewer federal permit requirements. The bill removes the need for permits under section 404 of the Clean Water Act and sections 7, 9, and 10 of the Endangered Species Act for those projects.
  • State and tribal reviews and communities: A state or tribal environmental review that a lead agency finds "functionally equivalent" to the National Environmental Policy Act review could substitute for NEPA. That shift gives more weight to state or tribal reviews and may change how federal environmental scrutiny applies to local waterways and species.
  • Courts and legal challengers: The bill would bar judicial review of federal or state approvals for these projects in most cases and funnel any legal claims about the law or approvals into original, exclusive jurisdiction in the D.C. Circuit.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 0 costs, 2 mixed.

Agencies could accept state or tribal reviews

The bill would amend federal environmental review rules. A federal lead agency could rely on a State or Tribal environmental review instead of a separate federal review. This would be allowed when the review considered relevant environmental information and the public was informed. If enacted, this could reduce duplicate reviews and speed decisions. The change would take effect upon enactment.

Fast track for $1 billion factory projects

If enacted, this would fast-track very large factory projects in the U.S. It would define these as builds or expansions costing at least $1 billion and needing at least one federal approval. These projects would not need certain Clean Water Act and Endangered Species Act permits. Most court challenges to approvals of these projects would be blocked; any claim about this section’s validity would go to the D.C. Circuit. Changes would take effect upon enactment.
