- Living kidney donors: Would be protected from adverse underwriting or pricing that is based only on donor status. A living kidney donor is defined as an individual who has donated a kidney and is not deceased.
- Life insurance companies: Could no longer base offer, issuance, cancellation, pricing, terms, or coverage amounts solely on donor status but may rely on unrelated actuarial evidence.
- People harmed by discrimination: Would gain a private right of action to sue in United States district court for damages and attorneys' fees.
- State and local laws: Would not be preempted when they provide greater protections for living kidney donors.

New protections for kidney donors' life insurance
If enacted, life insurers would be barred from denying, canceling, or limiting a policy just because you donated a kidney. They could treat you differently only if they show added actuarial risk not caused by the donation. If harmed, you could file an individual lawsuit in federal district court to seek damages and attorney’s fees. Stronger state or local donor protections would still apply where they exist. These protections would start upon enactment.
