Sponsored By: Representative Moolenaar, John R. [R-MI-2]

Introduced

Summary

Blocking U.S. agencies from using AI produced by foreign adversaries. This bill would require the Federal Acquisition Security Council (FASC) to build and publish a public list of artificial intelligence produced or developed by foreign adversaries and would bar executive agencies from acquiring or using listed systems except for narrow, approved exceptions for research, testing, or security work.

  • Federal agencies would have 90 days to review and consider removing AI from covered foreign adversaries and must use procurement authorities in 41 U.S.C. 4713 to exclude or remove covered products.
  • The Council would publish the list on a public website and update it at least every 180 days. Entities count as foreign adversary entities if a foreign person directly or indirectly owns at least 20 percent, which could affect suppliers.
  • Exceptions could allow acquisition for scientifically valid research, evaluation, training, testing, counterterrorism, counterintelligence, or to avoid jeopardizing mission-critical functions. Exceptions must be approved by written notice to the Office of Management and Budget Director and the relevant congressional committees.

Public list and federal limits on adversary AI

This bill would require a public list of AI made by foreign adversaries. FASC would create the list within 60 days. OMB would post it online within 180 days. FASC would update the list at least every 180 days. Federal agencies would have 90 days to review listed AI and consider excluding or removing it from use. They would use existing federal exclusion powers at a minimum. Agencies could allow narrow exceptions for research, testing, counterterrorism, or to protect mission‑critical work, with written notice to OMB and the Senate Homeland Security and Governmental Affairs and House Oversight and Government Reform Committees. An AI maker could seek removal by certifying it is not from a foreign adversary, and FASC would need to confirm. The bill uses existing federal definitions for AI, executive agencies, and foreign adversaries, including a 20% foreign ownership test for covered entities.
