Small business credit for drug research

If enacted, eligible small businesses could claim a new nonrefundable tax credit. The credit would equal 10% of qualifying research costs to prevent, treat, or reduce harms from specified drugs. Covered drugs would include fentanyl, fentanyl-related substances, methamphetamine, and drugs named an "emerging drug threat" by federal authorities. Clinical research would be excluded unless it follows NIH clinical research rules. The credit would apply to tax years beginning after enactment and would use the existing R&D credit small-business test.
