  • Victims and families: It would require that any obscene visual depiction remain in the Government's or the court's custody and let an identifiable minor depicted access the depiction under the same terms ordered for victims. It would also remove the statute of limitations for those obscene visual-depiction offenses.
  • People accused and convicted: It would broaden the production offense to cover materials mailed, shipped, or transported in or affecting interstate or foreign commerce, add related offenses to federal child-exploitation statutes, create a presumption of detention pending trial for specified offenses, expand sex-offender registration, and add post-imprisonment supervised-release requirements.
  • Law enforcement and courts: It would expand the set of offenses treated as child exploitation for purposes of discovery, detention decisions, registration, and post-conviction supervision, giving prosecutors and courts broader authority to pursue and manage these cases.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 2 benefits, 0 costs, 0 mixed.

Stronger rules for child abuse images

If enacted, judges would presume detention before trial for certain child‑exploitation charges, including obscene visual depictions. Any images in these cases would stay in government or court custody. A minor shown in an image could see it only under strict, court‑ordered limits. People convicted would have to register as sex offenders and face supervised release after prison. The bill would remove the statute of limitations for these crimes. These changes would take effect upon enactment.

Broader federal reach on child pornography production

The bill would widen when federal prosecutors can charge production of child pornography. A case could proceed if the image will be sent across state lines, if the tools or materials came from out of state, or if the image itself crosses state lines. This would expand federal reach into more cases. It would take effect upon enactment.
