FAITH in Small Business Act

Sponsored By: Representative Mann, Tracey [R-KS-1]

Introduced

Summary

Allows faith-based organizations to access SBA loan and disaster assistance programs. This bill would codify a proposed Small Business Administration rule so religious organizations that otherwise qualify can apply for the Intermediary Lending Program, 7(a), microloan, 504 programs, Economic Injury Disaster Loans, Military Reservist EIDL, and Immediate Disaster Assistance.

Show full summary
  • Religious nonprofits: Would be able to seek SBA business loans and disaster aid even if they are principally engaged in religious instruction, provided they meet other program requirements.
  • Local communities after disasters: More faith-based local actors could compete for EIDL and Immediate Disaster Assistance, potentially expanding sources of recovery funding.
  • Agency legal stance: Makes the proposed SBA rule have the force of law to align SBA policy with recent Supreme Court decisions that bar denying public benefits solely because of an organization’s religious character.

Equal small-business aid for faith-based groups

If enacted, faith-based organizations would get the same treatment as other applicants for Small Business Administration (SBA) loans and disaster aid. The bill would make the SBA rule issued January 19, 2021, legally binding. This could improve access and clarify eligibility for faith-based applicants. It would take effect upon enactment.
