  • Operators and operator-applicants: Would bar an adverse action based in whole or part on Motor Carrier Management Information System reports unless the operator gets notice consistent with the Fair Credit Reporting Act and a reasonable time to start and complete an appeal.
  • Employers and carriers: Would clarify that screening can be used for employment and employment-related checks and would remove the strict preemployment-only limitation, while keeping use voluntary under specified limits.
  • Data and dispute handling: Would require contested safety violations to be labeled as contested in MCIMS and related systems until review finishes, with that change required within 1 year.
  • States and appeals: Would direct the Secretary to issue DataQs participation guidelines within 1 year that require States receiving motor carrier safety assistance funds to provide an appeals process and to ensure appeals are decided by someone other than the original issuer within a reasonable period.

New screening and appeal rules for drivers

If enacted, this bill would let motor carriers use the same safety screening rules for current drivers and job applicants. The bill would replace the word "preemployment" with "preemployment or employment" and add "driver-related" and "safety" to clarify what issues count. Within one year, the Department of Transportation would require states to label any safety violation under review as contested in MC-MIS and other databases until the review finishes, and to provide an appeals process decided by someone other than the original issuer. Employers and others would not be allowed to take an adverse action based on MC-MIS data unless they give notice consistent with the Fair Credit Reporting Act and allow a reasonable time to start and complete the appeal.
