REUSE Act of 2026
Sponsored By: Representative Neguse, Joe [D-CO-2]
Introduced
Summary
Reuse and refill systems: This bill would require the Environmental Protection Agency (EPA) to study how refillable and reusable product and beverage systems could be scaled across sectors like food service, consumer food and beverage products, cleaning and personal care products, shipping, and public education. The study would analyze feasibility, equity, job opportunities, costs and barriers and must be published within two years.

- EPA reporting and scope. EPA would have two years to publish a public report describing feasibility and best practices for reuse and refill systems across the sectors the agency chooses to evaluate. In preparing the report, EPA must consider State, local, and foreign programs and consult with relevant reuse and refill stakeholders.
- Business, waste-management and jobs. The report would evaluate economic costs and benefits for businesses that deploy reuse and refill technologies and for parties responsible for waste collection and management. It would also identify job creation opportunities tied to adopting or expanding reuse and refill systems.
- Equity, scale and support needed. The study must assess what types of reuse and refill systems work best at different scales and how to ensure equitable distribution in communities of different sizes. It must describe the local, State, and Federal supports needed and identify existing barriers to wider implementation.

EPA definition for reuse systems
If enacted, this bill would tell the EPA what counts as a “reuse and refill system.” The Administrator would define systems that use refillable or reusable products and beverage containers. The definition would require producer-level collection, recovery, inspection, repair (if needed), and reissue for multiple reuse or refill cycles. The definition would also require convenient and safe retail infrastructure so consumers can reuse or refill items. The definition would take effect upon enactment and guide how the EPA applies related rules.
