No Immunity for Glyphosate Act

Sponsored By: Representative Massie, Thomas [R-KY-4]

Introduced

Summary

Removes federal immunity for makers and sellers of glyphosate-based herbicides and elemental phosphorus. This bill would let people harmed by exposure sue manufacturers, distributors, formulators, suppliers, and sellers in U.S. district court and bar immunity defenses tied to the Defense Production Act or federal contractor status.

  • Families and exposed individuals would be able to seek compensatory and punitive damages, equitable relief, and attorney fees for injuries or wrongful death. Claims arising before, on, or after enactment are covered and pending suits are preserved.
  • Covered entities — including manufacturers, distributors, formulators, suppliers, and sellers — would face private federal lawsuits and could not claim immunity under the Defense Production Act or the Federal Contractor Defense. Actions may proceed in federal court without regard to amount in controversy or citizenship.
  • The bill would bar use of Federal funds to implement, administer, or enforce the February 18, 2026 Executive Order titled "Promoting the National Defense by Ensuring an Adequate Supply of Elemental Phosphorus and Glyphosate-Based Herbicides."

New federal lawsuits for glyphosate harms

If enacted, you would be able to sue in federal court if you were physically harmed by exposure to elemental phosphorus or a glyphosate-based herbicide made, sold, or supplied in the United States. The bill would define covered entities broadly and allow awards for medical bills, lost income, pain and suffering, wrongful death, punitive damages, injunctive or declaratory relief, and attorneys' fees and costs. It would bar companies from using federal immunity defenses, including defenses under the Defense Production Act or federal orders, as a shield. The bill would also preserve state-law rights and would not force dismissal of existing or pending civil cases.

No federal funds for glyphosate order

If enacted, no federal money could be used to implement, administer, or enforce the Executive order titled "Promoting the National Defense by Ensuring an Adequate Supply of Elemental Phosphorus and Glyphosate-Based Herbicides," issued February 18, 2026. Federal agencies would be barred from spending appropriated funds to carry out that specific order. The bill does not provide replacement funding for those activities.
