Show full summary
  • Physicians: Doctors who perform abortions would have to hold admitting privileges at a hospital within 15 miles of their main office and the abortion site. They would also have to tell patients which hospital can provide follow-up care if complications arise, and knowingly failing to comply could bring a fine or up to 2 years in prison.
  • Clinics: To receive federal funds or assistance, an abortion clinic would have to be licensed by its state and meet federal ambulatory surgical center standards, with limited structural waivers allowed by a state board of health as determined by the Secretary of Health and Human Services.
  • Patients: A woman who undergoes an abortion would not be prosecuted under this provision.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 2 costs, 0 mixed.

New doctor rules and penalties

This bill would require any physician who performs an abortion to have admitting privileges at a hospital within 15 miles of their main office and the procedure site. The doctor would also have to tell the patient the hospital where the doctor can provide follow-up care at the time of the abortion. The bill would make it a federal crime to knowingly perform an abortion without meeting these rules, punishable by a fine, up to 2 years in prison, or both. The bill says the woman receiving the procedure could not be prosecuted under this rule.

Stricter clinic rules for federal funds

This bill would make clinics that get any federal money follow State licensing and ambulatory surgery center standards. It would apply to non-hospital clinics that perform first, second, or third trimester abortions in a 12-month period. States could waive some building or structural rules if HHS says it is appropriate. If enacted, some clinics could face higher costs, lose funding, or close, making care harder or more expensive to get.
