Defending Women in the Workplace Act

Sponsored By: Representative Biggs, Sheri [R-SC-3]

Introduced

Summary

This bill would explicitly exclude gender identity from the meaning of "because of sex" and "on the basis of sex" in Title VII of the Civil Rights Act. It creates a narrow rule of construction for Title VII so that discrimination claims based on gender identity would not be treated as sex-based discrimination under that statute.

Less federal protection for transgender workers

If enacted, this bill would change how Title VII treats sex discrimination. It would say the phrases "because of sex" and "on the basis of sex" do not include gender identity. If you are transgender or gender nonconforming, you would lose federal protection under Title VII. That means you could not use Title VII to sue over employment decisions based on gender identity. Employers could face fewer federal discrimination claims. The change would take effect upon enactment.
