Introduced

Summary

Voids federal endangered and critical-habitat protections for six freshwater mussels. The bill invalidates the U.S. Fish and Wildlife Service final rule (published June 4, 2024) that would have listed Guadalupe fatmucket, Texas fatmucket, Guadalupe orb, Texas pimpleback, Balcones spike, and false spike as endangered or threatened and that included a Section 4(d) rule and critical habitat for Texas fawnsfoot. By declaring that rule void, the measure preserves the legal status quo that existed before the rule and prevents the protections and habitat designations in that rule from taking effect.

Block new Texas mussel protections

This bill would void a Fish and Wildlife Service final rule from June 4, 2024 (89 Fed. Reg. 48034). That rule lists several Texas freshwater mussels as endangered or threatened and sets critical habitat. It also includes a Section 4(d) rule for the Texas Fawnsfoot. If enacted, landowners, builders, and small businesses in the covered areas would not face those new Endangered Species Act limits. Protections for those mussels and their habitat would not take effect.
