Sponsored By: Representative Ruiz, Raul [D-CA-25]

Introduced

Summary

Would create a program to pay U.S. seasonal and perishable specialty crop producers when imports cause price declines. This bill would start payments in marketing year 2027 and would trigger if the national market price during a crop's seasonal marketing window falls below a three-season reference price and the Secretary of Agriculture determines imports caused the loss.

  • Farmers of covered seasonal and perishable specialty crops: Eligible producers would receive annual payments equal to the difference between the reference price and the effective price multiplied by their previous three-year average production for that marketing window.
  • Eligibility limits for producers: Payments would go to producers with an average adjusted gross income below $5,000,000 for the prior three tax years or who derive at least 75% of their adjusted gross income from farming, ranching, or forestry in the payment year.
  • Geographic and crop scope: Coverage is limited to U.S. regions where the crop is grown and normally harvested and shipped within an eight-week post-harvest marketing window, and to fresh or chilled specialty crops identified by HS2020 tariff codes.
  • Administration and trigger: The Secretary of Agriculture would run the Seasonal and Perishable Crop Loss Program under a new Title V to the Specialty Crops Competitiveness Act and would make the annual price and causation determinations that trigger payments.

Payments for seasonal specialty crop farmers

This bill would create a Seasonal and Perishable Crop Loss Program starting with the 2027 marketing year. The Secretary of Agriculture would make annual payments to eligible producers when the national average price during a crop's seasonal marketing window is below the three-season reference price and the Secretary determines imports caused the price shortfall. Payments for the last seasonal marketing window would equal (reference price − effective price) times the producer's previous three-year average production for that window. To qualify, a producer's three-year average adjusted gross income would have to be under $5,000,000, or at least 75% of adjusted gross income for the tax year would need to come from farming, ranching, or forestry. Covered crops would be fresh or chilled specialty crops sold raw and normally marketed within eight weeks of harvest, including tariff codes HS2020 0701–0709 and 0803–0810 (or successor codes). Payments would apply only in U.S. regions where the crop is grown in a seasonal marketing window with an annual normal harvest and shipment.
