Wildfire Reduction Market Expansion Act of 2026
Sponsored By: Representative Bentz, Cliff [R-OR-2]
Introduced
Summary
Expand the definition of renewable biomass under the Clean Air Act so more forest- and wood-product leftovers qualify for Renewable Fuel Standard credits. The bill would also add formal certification paths and make material from defensible space and wildfire risk reduction activities eligible.

More biomass eligible for renewable credits
This bill would broaden what counts as "renewable biomass" for renewable fuel credits. It would add many wood and paper manufacturing leftovers, including sawdust, wood chips, shavings, bark, sanding dust, and paper-recycling residuals, but would exclude paper in commonly recycled form. Vegetation removed for defensible space or for wildfire-risk reduction in the wildland-urban interface would qualify when removed under applicable local law or the latest International Wildland-Urban Interface Code and when the wildfire-risk activity fits the Healthy Forests Restoration Act definition. Materials from non-Federal land would qualify if the land is under a forest sustainability certification, is classified by state/local property tax for forestry, or the landowner signs an attestation of long-term timber management. Materials from National Forest or other public lands would qualify only if the Secretary of Agriculture or the Interior certifies to EPA that they are by-products of authorized land-management activities and are not reasonably suitable as sawlogs. The bill would let EPA issue letters to certify eligibility, including landowner letters for non-Federal land and local USDA or DOI office letters for Federal lands, and it would say a forest or resource plan need not name renewable fuel as an intended use so long as the project is otherwise authorized and consistent with the plan.
