119-hres-78119th Congress

Amending the Rules of the House of Representatives to permit certain resolutions to be privileged only if they are based on conduct which was the subject of an investigation and report by the appropriate committee of jurisdiction or if they are offered by direction of a party caucus or conference.

Summary

Limits when certain disciplinary and impeachment resolutions get treated as privileged business in the House. It would require that a resolution to impeach an officer, to censure, reprimand, or expel a Member, or to create a vacancy in key House leadership get a committee investigation and report or be offered at the direction of a party caucus or conference before it can be raised as a question of privilege.

  • Members and officers: Individual members could not force immediate floor consideration of impeachment or censure without a committee report or formal party caucus direction, making emergency floor actions harder.
  • Committees: Committees gain a clear gatekeeping role because an investigation and written report would be needed to make these types of resolutions privileged.
  • Party caucuses and conferences: A party caucus or conference can still fast-track a resolution by formally directing it, bypassing the committee-report requirement.

Limit privileged disciplinary motions

If adopted, the resolution would add a new paragraph to House Rule IX. It would bar certain resolutions from being treated as privileged unless one of two things happened. Either the committee of jurisdiction had investigated and filed a report recommending the sanction, or the resolution was offered by direction of a party caucus or conference. The rule would cover impeachment of a government officer; censure, reprimand, or expulsion of a Member, Delegate, or Resident Commissioner; and motions to vacate the Speaker or a committee chair or ranking minority member.
