Tougher court rules for executive suits
This bill would change how courts handle emergency lawsuits against the President and executive agencies. The judge who gets a three-judge request would have to notify the Chief Justice. The Chief Justice would randomly pick three active judges from across the federal bench. At least one designee would have to be an active circuit judge, and no more than two could come from the same circuit. The original judge could serve only if randomly selected and is an active district judge. A single judge could no longer grant temporary restraining orders, stays, or injunctions in these cases. A majority of the three-judge panel would have to approve any preliminary or permanent equitable relief. Single judges also could not appoint masters or send these cases to magistrate judges in such actions.
