Living Donor Protection Act of 2025
Sponsored By: Senator Cotton, Tom [R-AR]
In Committee
Summary
Insurance protections for living organ donors. This bill would stop life, disability, and long-term care insurers from denying coverage, canceling policies, or raising premiums solely because someone donated an organ or bone marrow when there is no unique, material actuarial risk.
Show full summary
- Donors and families: Living organ donors would face fewer insurance barriers when seeking life, disability, or long-term care coverage so long as donation does not create a proven actuarial risk.
- Workers and caregivers: The bill would treat organ donation, preparation, surgery, recovery, and related activities as qualifying serious health conditions under the Family and Medical Leave Act so eligible employees can use FMLA leave for donation. It also clarifies leave rules for federal civil service employees who serve as donors.
- Regulators and public outreach: State insurance regulators enforce the insurance rules under state law. The Department of Health and Human Services, working with Labor, must update living-donor educational materials within six months and may run public announcements and update websites.

Bill Overview
Analyzed Economic Effects
3 provisions identified: 3 benefits, 0 costs, 0 mixed.
Job-protected leave for organ donors
If enacted, organ donation, preparation for donation surgery, and recovery would count as a "serious health condition" under the Family and Medical Leave Act and parallel federal civil service rules. Eligible private-sector employees and covered federal civil service employees could use up to 12 weeks of job-protected leave for donation activities. If enacted, a federal civil service employee who uses any part of that 12-week leave to donate would be able to substitute any paid leave available under 5 U.S.C. 6327(b)(2) for as much of that donation-related leave as possible.
Insurance protections for organ donors
If enacted, insurers could not deny, cancel, refuse to issue, or raise premiums for life, disability, or long-term care insurance solely because you are a living organ donor. That protection would apply only when the action is taken solely on donor status and there are no actual, unique, and material actuarial risks tied to donation. State insurance regulators could enforce the rule only to the extent state law specifically authorizes such enforcement.
Updated federal donor education materials
If enacted, the Department of Health and Human Services would review and update living organ donation education materials within 6 months of enactment. The updates must include information about the bill's insurance protections and the FMLA and federal leave changes. HHS could also use public service announcements and update websites or other media to share the information, coordinating with the Secretary of Labor as appropriate.
