Introduced

Summary

  • Livestock producers and their employees: Would be authorized to capture, kill, disperse, or transport a black vulture carcass when they reasonably believe the bird will harm livestock. They may injure a bird while taking it but may not use poison.
  • U.S. Fish and Wildlife Service: The Director would have to develop and post a reporting form on the agency website within 180 days of enactment. Covered persons must submit an annual report to the appropriate regional office by January 31 using that form once it is available.
  • Scope and limits: The authorization applies only to the black vulture (Coragyps atratus) and to livestock producers and employees actively engaged in livestock production. The bill ties its terms to existing Migratory Bird Treaty Act and federal geographic rules.

New vulture rules for livestock producers

If enacted, the bill would let livestock producers and their employees take black vultures (Coragyps atratus) that are harming livestock. 'Take' would include capturing, killing, dispersing, or transporting a carcass. A covered person would be a livestock producer or an employee actively engaged in production. The bill would ban using poison to take vultures. If enacted, covered persons who took a vulture would need to file one annual report by January 31. The report must cover the prior 12 months. The Director of the U.S. Fish and Wildlife Service must post the official form within 180 days after enactment. Reports are not required until that form is available, and the form may not be more onerous than similar MBTA permitted-take forms.
