Sponsored By: Senator Ernst, Joni [R-IA]
Introduced
Summary
Requires states to recoup all SNAP overpayments and links state penalties to how much they fail to recover. It would also eliminate the small‑error tolerance starting in fiscal year 2025 and raise the multiplier used to calculate state liability.

- States: Would require State SNAP agencies to seek recoupment of any benefit overpayments and change the liability calculation so penalties reflect the share of overpayments not recovered. The bill raises the liability multiplier to 25% from 10%.
- SNAP households: Would remove the small‑error tolerance and set that floor to $0 for fiscal year 2025 and each year after, increasing the likelihood that even small overpayments are pursued for recovery.
- Program oversight and accountability: Would convert discretionary quality‑control language into mandatory duties and tie a State agency's payment error liability directly to its recoupment performance, shifting how federal quality controls penalize errors.

Tighter SNAP error and recoupment rules
This bill would change how SNAP payment errors are counted. For fiscal year 2025 and each year after, the small-error tolerance for excluding errors would be set to $0. For those years, the payment-error rate used to compute a State's liability would equal the State's payment error rate multiplied by the share of total overpayments the State did not recoup that year. The bill would also replace the numeric threshold "10" with "25" in the liability rule. The bill would require each State agency to seek to recoup any benefit overpayments. If enacted, SNAP households could be more likely to have small overpayments counted or to be asked to repay money.
