INSULIN Act of 2026
Sponsored By: Senator Shaheen, Jeanne [D-NH]
In Committee
Summary
Insulin cost‑sharing caps are the centerpiece of this bill. It limits what patients pay for insulin across private plans, forces rebate pass‑through to plans, and speeds biosimilar competition to lower prices.

Bill Overview
Analyzed Economic Effects
3 provisions identified: 3 benefits, 0 costs, 0 mixed.
Lower insulin costs for insured people
If enacted, group and individual health plans would have to cover certain "selected insulin products" without applying any deductible. For plan years that start before January 1, 2028, patient cost-sharing would be capped at $35 per 30‑day supply. For plan years that start on or after January 1, 2028, patient cost‑sharing would be the lesser of $35 or 25% of the plan's negotiated net price per 30‑day supply. These payments would count toward a plan's deductible and out‑of‑pocket maximum. ERISA‑covered employer plans would follow the same rules. Prior authorization and similar limits would be barred except for clinical safety or reasonable quantity limits. For plan years beginning on or after January 1, 2028, insurers would not be allowed to treat the insulin deductible exemption as increasing a plan's actuarial value for marketplace calculations.
Help for uninsured people needing insulin
If enacted, HHS would fund an Insulin Resource Center run by non‑manufacturer groups and a 24/7 hotline to help uninsured people find assistance. The center would get $2,000,000 per year for fiscal years 2027 through 2032. The bill would also create a five‑year state pilot giving grants to 10 States to provide affordable insulin to uninsured people. The pilot is authorized $100,000,000 for fiscal year 2027, available until spent, and would fund insulin at FQHCs, pharmacies, and other assistance programs. States must report within one year on spending and people served.
Speed biosimilars and curb delays
If enacted, the FDA would get a new "competitive biosimilar" designation when a market has fewer than three licensed products and three years have passed since exclusivity ended. The FDA would decide designation requests within 60 calendar days. Designation would give sponsors more meetings, senior management attention, and faster reviews and reinspections. Sponsors would report within one year after licensure whether the product was marketed. The bill would also tighten citizen petition timing, generally requiring petitions within 180 days after the filer knew the facts and letting FDA identify petitions meant mainly to delay approval.
