Title X Abortion Provider Prohibition Act

Sponsored By: Senator Blackburn, Marsha [R-TN]

Introduced

Summary

Prohibits Title X funding for any organization that performs or financially supports abortions. It would allow abortions only in narrow cases — rape, incest, or when a physician certifies a life‑threatening physical condition — and would require regular reports to Congress on grantees and abortions performed under those exceptions.

Show full summary
  • Title X grantees would have to certify they will not perform abortions or provide Title X funds to any entity that does. The bill defines "entity" to include the entire legal organization and its affiliates.
  • Hospitals would be exempt from the ban if they do not give Title X funds to non‑hospital entities that perform abortions. Abortions under the rape, incest, and physician life‑threat exceptions do not count against hospitals.
  • Patients would only be able to receive abortions at Title X-funded entities under the narrow rape, incest, or physician-certified life‑threat exceptions.
  • The Secretary would have to report to Congress not later than 60 days after enactment and annually, listing each grantee, each subrecipient of Title X funds, each grantee's latest certification date, and counts of abortions by exception (rape, incest, physician certification).

Limits Title X family-planning funding

If enacted, the bill would bar HHS from giving Title X money to any group unless the group certifies it will not perform abortions. It would also bar groups from giving Title X funds to others that perform abortions while they get the funds. Exceptions would allow abortions for rape, incest, or when a physician certifies a life‑threatening condition or danger of death. Hospitals could still get funds if they do not pass money to non‑hospital abortion providers during the assistance period. The Secretary would have to report to Congress within 60 days and then every year. The report would list grantees, each grantee's latest certification date, which entities get Title X funds from grantees, and counts of abortions done under the exceptions by rape, incest, and physician certification.
