Advance payments allowed for bus purchases
If enacted, transit agencies that get federal transit funds would be allowed to use that money to make an advance payment to a bus manufacturer. Each advance payment could be no more than 20% of the total purchase order value. Agencies would be able to do this without needing pre-approval or a performance bond from the manufacturer. Agencies would need a signed purchase order and an executed contract with advance-payment terms. They would also need preaward authority and to meet subsection (m) and section 5318(e) requirements. If enacted, this would take effect upon enactment.
