Protecting American Agriculture from Foreign Adversaries Act of 2025
Sponsored By: Senator Marshall, Roger [R-KS]
Introduced
Summary
Requires CFIUS to review certain agricultural land deals referred by USDA and adds the Agriculture Secretary to the committee. The bill would make CFIUS decide whether USDA-flagged purchases by foreign persons from China, North Korea, Russia, or Iran need a national security review for agricultural land, biotechnology, and related industry assets.
Show full summary
- Farmers and landowners: Sales or leases of agricultural land to buyers from China, North Korea, Russia, or Iran that USDA flags would be subject to CFIUS scrutiny and may trigger a national security review or other federal action.
- Agriculture businesses: The Secretary of Agriculture would sit on CFIUS for covered agriculture transactions, giving USDA direct input on reviews of agricultural biotechnology and supply-chain assets like transportation, storage, and processing.
- Scope and timing: The rule applies to transactions that must be reported under the Agricultural Foreign Investment Disclosure Act and only covers foreign persons from the four named countries. The requirement to refer those countries would end if a country is removed from the federal covered-adversary list.

New foreign-investment review for farms
If enacted, this bill would add the Agriculture Secretary as a CFIUS member for certain farm-related deals. It would apply after the Secretary reports a reportable agricultural land transaction. That means a purchase of an interest in agricultural land by a person from China, North Korea, Russia, or Iran that is reportable under section 2(a) of the Agricultural Foreign Investment Disclosure Act (7 U.S.C. 3501(a)). After the report, CFIUS would decide whether the deal is a covered transaction and whether to open a formal review or take another authorized action. The rules would take effect on enactment and would end for a country when that country is removed from the foreign-adversaries list in 15 C.F.R. 791.4.
