Honor Our Living Donors Act

Sponsored By: Senator Luján, Ben Ray [D-NM]

Introduced

Summary

Bars consideration of an organ recipient's income when reimbursing living donors under federal grant programs. This bill would change the Public Health Service Act so grant recipients providing donor reimbursements may not factor the recipient's income and would add annual public reporting on whether grants covered donor expenses.

Show full summary
  • Donating individuals: Donors would receive reimbursements under these grants without regard to the organ recipient's income. This removes income as a criterion when programs decide donor payments.
  • Organ recipients: The bill removes statutory language that created an expectation that organ recipients would make payments to donors.
  • Federal reporting and oversight: The Secretary must publish and send Congress an annual report by December 31 each year that estimates how many donors did not get full reimbursement and the total funding needed to fully reimburse all qualifying donor expenses.

Protect living organ donor reimbursements

If enacted, grant recipients that reimburse living organ donors could not consider the organ recipient's income when deciding payments. If enacted, the Health and Human Services Secretary would have to publish a report each year by December 31. Each report would estimate how many donors did not get full reimbursement the prior fiscal year and how much money is needed to fully reimburse them. If enacted, this change would take effect upon enactment.
