Summary
Prohibits enforcement of nondisclosure or confidentiality clauses that silence reporting of sexual abuse of minors. This bill would void contract terms that bar victims or witnesses from disclosing sexual abuse or sex trafficking of anyone under 18 and preserve survivors' access to courts and to petition the government for redress.

Ban NDAs That Silence Child Abuse
This bill would say Congress can use the Necessary and Proper Clause and section 5 of the 14th Amendment to act against NDAs that hide child sexual abuse. It would treat state-court enforcement of those NDAs as state action that can violate survivors' constitutional rights. The bill would bar State courts and other government authorities from enforcing nondisclosure or confidentiality clauses that silence reports of sexual abuse of a minor. If enacted, survivors, witnesses, and families would be able to disclose abuse or seek court remedies despite those NDAs.
