Summary

Creates a refundable tax credit that lets sellers recoup amounts they pay toward a first-time buyer’s purchase costs. This bill would allow a seller of their principal residence to claim a credit equal to the lesser of what the seller paid for the buyer’s qualified home acquisition expenses or the tax liability reduction from excluding the gain on the sale.

Tax credit for home sellers

If enacted, you would be able to claim a refundable federal tax credit when you sell your main home to a first-time homebuyer during the tax year. The credit would equal the smaller of (1) what you paid for the buyer's qualifying costs (down payment, inspection costs, and closing costs), or (2) how much your tax bill would fall if the gain from the sale were excluded from your income. A first-time homebuyer is the buyer (and, if married, the buyer's spouse) who did not own a main home during the two years before the sale. The Treasury would issue rules to implement the credit, and it would apply for tax years beginning after December 31, 2026.
