Importers: Don't Miss the Antidumping Duty Review Deadline!

Summary

If you’re involved in importing goods that might be subject to special U.S. taxes called antidumping or countervailing duties, now’s your chance to ask for a review or join the annual update list. The Department of Commerce is setting deadlines and rules for who gets reviewed, using import data to pick companies. Act fast—missing deadlines could mean missing out on important changes that might affect your costs or business.

Request Review by April or Face Duties

If you import goods covered by the listed antidumping or countervailing duty orders, you must request an administrative review not later than the last day of April 2026. If Commerce does not receive a timely request for a listed order, it will tell U.S. Customs and Border Protection (CBP) to assess duties on those entries at a rate equal to the cash deposit and to continue collecting the cash deposit.

Nonmarket-Economy (NME) Entity Not Automatically Reviewed

Commerce will not treat the nonmarket-economy (NME) entity as automatically under review; the NME entity will only be under review if Commerce receives a request to review it or self-initiates a review. If an individual exporter in an AD review does not qualify for a separate rate, Commerce will treat that exporter as part of the NME entity and the NME entity's rate will not change due to that review.

Respondent Selection Uses CBP Data

If Commerce limits the number of companies it examines, it will select respondents based on CBP import data for the period of review. Commerce intends to release CBP data under an administrative protective order (APO) within five days of the initiation notice and make the respondent-selection decision within 35 days of that notice.

Deadline for Particular Market Situation Claims

If you want to submit a Particular Market Situation (PMS) allegation under section 773(e) of the Act, you must file the PMS allegation and supporting factual information no later than 20 days after you submit initial Section D responses. Commerce will consider PMS allegations consistent with its procedures and may modify dumping calculations if it finds a PMS.

Annual Inquiry Service List Update Deadline

Commerce will update the annual inquiry service lists for the listed proceedings; interested parties have 30 days after the date of this notice to submit new or amended entries of appearance. Commerce will finalize the updated annual inquiry service lists five business days after that 30-day period. Petitioners and foreign governments that submitted an entry once are automatically kept on the list in later years.
