3 provisions identified: 0 benefits, 1 costs, 2 mixed.

Shorter notice for Lamar County sales

Beginning June 1, 2026, Lamar County advertises sealed-bid property sales for two consecutive weeks in a countywide newspaper. Notice must appear at least seven days before bids close and give the property's description and bid-opening details. This replaces four weeks of ads and a separate statewide newspaper ad. These rules cover county-owned or controlled land, buildings, equipment, and other property. Except for permitted auctions, sales and disposals require free, open competition through sealed bids. The commission chair must permanently record the property's description, condition, estimated value, and written authority for disposal. Bids are opened publicly, and bidders or their representatives can attend. Collusion invalidates bids and disqualifies bidders; early disclosure of bid information voids the proceedings. Property with trade-in value can count toward purchases made under state purchasing rules. All disposal proceeds go to the owning district's fund, or the county's general fund for county-owned property.

Lamar County auctions expand, notices shrink

Beginning June 1, 2026, Lamar County can sell county-owned or controlled tangible personal property through public bidding in person or online. Auctions replace the sealed-bid process for these sales, and the one-auction-per-year limit is removed. In-person auctions require two consecutive weeks of advance public ads stating the date, time, and location. Online auctions require no public advertisement. Lists of items for either type of auction must be available at county commission offices.

Lamar County drops property-sale felony penalty

Beginning June 1, 2026, knowing violations of Lamar County's property-disposal rules no longer carry this section's Class B felony penalty. The removed penalty included a fine of up to $15,000 and up to seven years in prison. Instead, county taxpayers and genuine unsuccessful bidders can ask the appropriate court to block contracts made in violation of these rules.
