Retired lawyers gain work with service limits

Beginning June 1, 2026, eligible Employees’ Retirement System and Teachers’ Retirement System retirees can work as assistant district attorneys and keep their pensions. They must be licensed to practice law in Alabama, and annual pay cannot exceed $52,000. Required service starts at 25 years. Each January 1, it rises to 26 years in 2028, 27 in 2029, 28 in 2030, 29 in 2031, and 30 in 2032 and later. No one can work under this authorization after December 31, 2032.

Retirees gain safety jobs with tighter limits

Beginning June 1, 2026, eligible Alabama public retirees can keep their pensions while doing covered public-safety work. Covered police jobs include sheriff’s deputy, municipal police officer, qualifying law enforcement officer, and state policeman. Police retirees need applicable Alabama peace officer certification and a law enforcement or state police classification before retirement. Department of Corrections officers need that certification, a prior correctional officer classification, and retirement under Section 36-27-16(a)(1)c. Covered firemedics need the required firefighter and emergency medical certifications; their pay must match the work performed. Annual pay cannot exceed $52,000. For these roles, required service rises each January 1: 25 years in 2027, 26 in 2028, 27 in 2029, 28 in 2030, 29 in 2031, and 30 in 2032 and later. The law extends the work deadline from December 31, 2030, to December 31, 2032; this authorization ends afterward.

Retirees keep pensions while driving full-time

Beginning June 1, 2026, Employees’ Retirement System and Teachers’ Retirement System retirees can take permanent full-time bus-driver jobs and keep their pensions. Annual pay cannot exceed $52,000. Retirees must first receive retirement benefits for 12 consecutive months, unless they retired on or before January 1, 2026. The bus-driver rule applies retroactively to January 1, 2023. No one can work under this authorization after December 31, 2032.
