Tighter rules for family land transfers

Beginning October 1, 2026, the law limits family land-transfer exemptions outside city limits. This rule applies in counties where local law does not require land divisions to use recorded plats. After an exempt transfer to an immediate family member, a direct transfer outside the immediate family within 24 months triggers county subdivision rules. Affected landowners must meet applicable plat approval, development permit, and filing requirements, which can add steps and costs.
