Required job protections for municipal workers

A municipality that leaves its county personnel board must create its own civil service system. It must protect existing county-system appointees' rights they have earned or are earning, except as otherwise provided by law. The municipality cannot engage in discrimination prohibited by state or federal law. It must adopt a policy banning favoritism or discrimination in hiring, promotion, demotion, and dismissal. That policy must cover political or religious views or affiliations, race, gender, and other reasons barred by law.

Some Alabama cities can leave personnel boards

The law lets qualifying Class 8 municipalities leave their county personnel board by passing an ordinance. They must span two counties and have at least 25,000 residents according to the last decennial census. They must also have been under a county personnel board on January 1, 2023. Leaving takes effect six months after the ordinance takes effect. Municipalities must wait at least 10 years after leaving before passing an ordinance to rejoin. Rejoining takes effect six months after that ordinance takes effect; copies of both types of ordinances must reach the board. The law takes effect immediately and replaces the earlier opt-out law, Section 11-43-5.2. It applies retroactively to confirm prior municipal opt-outs and civil service systems created under Act 2023-460.
