City school mergers get voter protest safeguards

Beginning October 1, 2026, two or more neighboring Alabama city school systems can merge under one remaining multi-city board. Each board must adopt and record a plan covering debts, the merger process, administration, board members’ duties, and timing. Eligible voters can require a public vote by filing a written protest with any affected board. This requires at least 25% of eligible voters in any one affected system to protest within 30 days after adoption. If that threshold is met, the merger needs majority approval from voters voting across the combined area. The vote takes place at the next regularly scheduled general election. Each affected county’s probate judge must order the election within one month after the 30-day protest period. Each county’s sheriff must give at least 30 days’ notice, and ballots must offer “For Consolidation” and “Against Consolidation.” Without a qualifying protest, or after voter approval, the merger is finalized on the resolution’s schedule. Existing debts, obligations, and rights remain protected; the agreement and resolution bind all parties. The new board can enforce contracts made with the earlier boards. The State Board of Education must adopt rules as needed to carry out the law.
