New reuse rules for coastal dredgers

Beginning October 1, 2026, anyone dredging more than 1 million cubic yards yearly in Alabama coastal areas must beneficially use at least 70%. Qualifying uses include fish and wildlife habitat, recreation, and industrial or commercial uses. Placing material in public waters counts only for shoreline restoration or marsh creation. Marsh creation establishes wetlands, islands, or marsh habitat; shoreline restoration restores or preserves existing shorelines and includes living shoreline projects. Restoration also includes placing material south of Dauphin Island or the Fort Morgan Peninsula to restore Dauphin Island or Sand Island. The reuse requirement applies only to the extent federal funds are available and allocated, and permitted, approved Alabama sites can accept suitable material. Recipients cannot use Alabama State General Fund appropriations to pay costs of complying with the requirement. The Governor can suspend the section through an emergency order or proclamation that names the section and gives an end date. Alabama's environmental management and conservation departments must adopt implementing rules and revise the coastal management program as needed. The law creates no private right to sue over these rules.
