Alabama campaigns face federal funds cap

Beginning October 1, 2026, Alabama state and local candidate campaign committees cannot receive or spend more than $1,000 raised by a federal candidate’s principal campaign committee. The cap also covers people authorized to spend money for the state or local committee. A person convicted of knowingly and willfully breaking this rule is guilty of a Class C felony.

Foreign election funding banned in Alabama

Beginning October 1, 2026, foreign nationals cannot give, promise, or spend money or valuable support in Alabama state or local elections. This covers candidate races, referendums, constitutional amendments, party committees, and political action committees, including independent spending and election-related communications. The ban covers actions taken alone or jointly, directly or through others. Foreign nationals include people who are neither U.S. citizens nor lawful permanent residents, foreign governments, foreign political parties, and foreign-organized or foreign-based entities. It also covers wholly or majority foreign-owned U.S. entities. Those U.S. entities are excepted when covered funds come entirely from U.S. operations and citizens or permanent residents make relevant decisions, except overall budget decisions. People, parties, and campaign committees cannot ask for or accept covered foreign funding; knowing and willful violations are Class C felonies upon conviction. Credible evidence that the source is not foreign protects recipients, and a no-foreign-funds solicitation notice creates a presumption that can be challenged. Such notices may accompany required campaign notices. Membership dues, conference attendance fees, and sponsorship fees are excepted when the organization is not foreign, funds come only partly from foreign nationals, and foreign nationals do not dictate election decisions. The Secretary of State and Alabama Ethics Commission are directed to use comparable federal guidance, and undefined terms follow federal standards.
