This legislation would let the Jefferson County sheriff appoint special reserve deputies during an "emergency writ condition". Those deputies would be able to help execute writs and similar actions to seize or secure real property in Jefferson County. A deputy would have the same legal immunities as deputies under Section 36-22-3 when acting within their duties and following the law. Before appointing someone, the sheriff would have to confirm state peace-officer certification, that the person is not employed by the sheriff's department, and that the person completed the sheriff's special-assignment writ training within the last three years. The sheriff would have to run and document the training and could charge a reasonable fee for it. These rules would take effect October 1, 2026.
This legislation would let a petitioner request that a special reserve deputy execute a seizure writ during an emergency writ condition. After the deputy executes and returns the writ to the proper clerk, the petitioner would have to pay the deputy a service fee of no more than $250 per writ. The deputy could not be paid from the county treasury, and the sheriff could not receive any fee for that service. This rule would take effect October 1, 2026.
