Limits on crime victim compensation payments

Beginning October 1, 2026, the Alabama Crime Victims Compensation Commission may reduce or deny payments based on the victim’s share of responsibility for the injury or death. It may also reduce or deny payments to the extent other sources repay the financial loss. Claimants cannot receive compensation if they committed the crime, helped the offender, or took part; awards also cannot unfairly benefit offenders or accomplices. The Commission may deny compensation when the crime was reported to law enforcement more than 72 hours later, unless there is good cause. It may deny, withdraw, or reduce an award if the claimant or victim has not fully cooperated with law enforcement.

More time to file victim claims

Beginning October 1, 2026, Alabama crime victim compensation claims have a two-year filing deadline after injury or death, up from one year. The Alabama Crime Victims Compensation Commission may accept later claims for good cause. It may also reconsider claim approvals, denials, or award amounts on its own or at a claimant’s request. Reconsideration does not require repayment of money already paid unless the award was obtained through fraud. The right to reconsideration does not change whether the Commission’s decision is final for court review.
