Beginning October 1, 2026, the law sets appointment and term rules for Alabama’s three-member Board of Pardons and Paroles. The board must reflect the state’s racial, gender, geographic, urban, rural, and economic diversity. At least one member must be a current or former law enforcement officer with at least 10 years of qualifying experience. That experience must involve an agency whose main duties include investigating violent crimes or catching, arresting, or supervising offenders. After a vacancy, the Lieutenant Governor, House Speaker, and Senate President Pro Tempore select five qualified candidates by majority vote. The Governor must appoint someone from that list within 10 days, subject to Senate confirmation. Appointees serve immediately, including temporarily when the Senate is outside its regular session. They are deemed confirmed if the Senate adjourns its session without voting on them. New members receive six-year terms starting March 1. Members serving on October 1, 2026, have terms ending on February’s last day following their term’s sixth year. Members serve until successors are appointed and qualified; replacement appointees fill only the remainder of an unfinished term. The Governor chooses the chair, and two members form a quorum. Members must take the constitutional oath and cannot hold another paid state office while serving. They are subject to constitutional impeachment rules. The Governor may direct the Attorney General to seek a court finding of incapacity; such a finding makes the seat vacant. Annual pay for the chair and other members is set by law and paid in equal State Treasury installments.
This rule took effect immediately. People serving community punishment and corrections sentences must leave program supervision immediately after a later conviction brings an Alabama prison sentence. They remain in Department of Corrections custody until that later confinement ends. Their community-program sentence pauses during confinement. They may return afterward unless the court orders otherwise or state law makes them ineligible.
