Beginning October 1, 2026, disability retirement is available to active, contributing Alabama District Attorneys’ Plan members with 10 years of membership service. The medical board must certify total, permanent mental or physical inability to do regular, substantial paid work and recommend retirement. Disability retirement takes effect 30–90 days after filing. Benefits include an annuity equal to the actuarial value of accumulated contributions at retirement. They also include a pension of 4% of average final compensation for each year of membership service. Total benefits are capped at 75% of average final compensation; members with at least 18 years receive exactly 75%. For recipients under 62, the Board of Control can require medical exams annually during the first five retirement years. After that, it can require exams once every three years, at home or another mutually agreed location. Refusing an exam can stop payments; refusal lasting one year can lead the Board to revoke all pension rights. If the medical board certifies ability to do regular, substantial paid work, the Board must stop payments until service-retirement eligibility.
