Tougher penalties for first-degree arson

Beginning October 1, 2026, Alabama expands first-degree arson to cover fires or explosions started during or to carry out theft. The fire, explosion, or accompanying theft must cause at least $25,000 in damage. The existing rule still covers intentionally damaging a building by fire or explosion when someone is inside and the offender knows this or their presence is reasonably possible. First-degree arson is a Class A felony with a prison sentence of at least 20 years. That sentence must run separately from, not overlap with, any other prison sentence arising from the same facts and circumstances.
