New penalties and defenses for monitored defendants

Beginning October 1, 2026, Alabama law creates the crime of third-degree bail jumping for breaking any court-ordered electronic monitoring condition. It applies to people lawfully released from custody, with or without bail. The offense is a Class C misdemeanor. Defendants have a defense if the violation was unintentional or unavoidable because of circumstances beyond their control. The defendant must prove that defense.
