Tougher penalties for school gunfire

Beginning October 1, 2026, Alabama raises firing into an occupied school bus or school building from a Class B to Class A felony. Firing into an unoccupied school bus or school building remains a Class C felony. Shooting on school property during school hours or school activities is a Class B felony; otherwise, it is Class C. The law removes the exemption for people under 19, making them subject to these rules and penalties. When another law also covers the conduct, the more serious penalty applies; other criminal laws remain in place.

School firearm exceptions and land limits

Beginning October 1, 2026, exceptions cover organized firearm competitions and firearm events sanctioned by the school system, replacing “school sanctioned.” Exceptions also remain for performances or practice by organized 501(c)(3) nonprofit groups that use firearms, and for school-system leased land. A person does not violate this section when their use of physical force is justified under Alabama Section 13A-3-23. The law excludes sixteenth section land and school lands held in trust for a school district from “school property.” This exclusion applies only when the land has no school buildings and is not actively used for students’ educational or recreational activities.
